Achiever Capital ("Achiever," "Achiever Capital," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit achievercapital.com (the "Site"), engage us for advisory, fiduciary, operations, capital, go-to-market, or assessment services, or otherwise communicate with us — including by email, phone, and SMS/text message.

By using the Site or communicating with us, you agree to the practices described in this Policy. If you do not agree, please do not use the Site or provide information to us.

Achiever Capital is a digital-first growth advisory firm built for private equity, with headquarters at 167 Madison Avenue, New York, NY 10016.

2. Information We Collect

We collect personal information that you provide directly, information collected automatically when you interact with the Site, and information from third parties.

Information you provide directly includes your name, business email address, business phone number (including mobile number), employer, title, mailing address, the content of messages you send us, scheduling and meeting information, and any other information you choose to share when you submit a form, request information, sign an engagement letter, attend an event, subscribe to our communications, or exchange business cards or contact details with our principals.

Information collected automatically when you visit the Site includes IP address, device identifiers, browser type and version, operating system, referring URL, pages viewed, links clicked, dates and times of access, and approximate geographic location derived from IP address. We collect this information using cookies, pixels, server logs, and similar technologies. See Section 8 (Cookies and Tracking Technologies) for more.

Information from third parties may include data we receive from our portfolio companies, sponsors, co-investors, partners, public business directories (e.g., LinkedIn), professional networks, event organizers, marketing analytics providers, and customer relationship management (CRM) tools such as HubSpot.

We do not knowingly collect personal information from children under 16, and the Site is not directed to children.


3. How We Use Your Information

We use personal information for the following purposes:

  • to provide, deliver, and improve our advisory, fiduciary, operating, transactional, and capital services;
  • to respond to inquiries, schedule meetings, and provide diligence or deal support;
  • to communicate with you about engagements, content, events, and firm announcements that are relevant to your role;
  • to operate, maintain, secure, and improve the Site;
  • to send SMS/text messages where you have a business relationship with us or have otherwise consented (see Section 5);
  • to comply with legal, regulatory, tax, accounting, audit, and contractual obligations;
  • to detect, prevent, and respond to fraud, abuse, security incidents, or unlawful activity; and
  • to establish, exercise, or defend legal claims.

4. Legal Bases for Processing

Where required by law, we process personal information on the following legal bases: your consent; the performance of a contract with you or steps taken at your request prior to entering into a contract; compliance with a legal obligation; and our legitimate interests in operating, securing, and growing our business, provided those interests are not overridden by your rights and freedoms.


5. SMS / Text Messaging

This section describes our SMS practices and is the controlling section for SMS-related disclosures required by mobile carriers, The Campaign Registry (TCR), and CTIA guidelines.

Program description. Achiever Capital uses SMS/text messaging to support one-to-one conversational communications with clients, prospective clients, portfolio company executives, partners, co-investors, advisors, and other business contacts. Typical messages relate to scheduling, meeting confirmations, follow-ups on inquiries you have made, time-sensitive diligence or engagement coordination, and other business communications connected to your relationship with us.

How we obtain your mobile number and consent. We send SMS messages only after you have provided your mobile number to us and consented to receive text messages from Achiever Capital. Consent is captured in one or more of the following ways:

  • Existing business relationship. You shared your mobile number with us in connection with a business inquiry, engagement, event, introduction, or ongoing relationship, and we informed you that we may text you about that relationship.
  • Verbal or written consent. During a call, meeting, or written exchange (including email), you confirmed that you agree to receive texts from us, after we informed you that you can reply STOP to opt out, reply HELP for help, that message and data rates may apply, that message frequency may vary, and that your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
  • Website opt-in (where offered). If you submit a form on the Site that requests your mobile number, you must affirmatively check a separate, unchecked SMS-consent checkbox. The checkbox language identifies Achiever Capital as the sender and discloses opt-out instructions before consent is given.

Message frequency. Message frequency varies and depends on your interactions with Achiever Capital. We do not send recurring marketing broadcasts.

Costs. Message and data rates may apply. Achiever Capital does not charge for the messages themselves; charges from your wireless carrier may apply based on your mobile plan.

Opt-out. You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After you reply STOP, you will receive one final confirmation message and will not receive further SMS communications from the same number unless you re-enroll. To re-enroll after opting out, reply UNSTOP or START, or contact us at privacy@achievercapital.com.

No sharing of SMS opt-in data. Achiever Capital will not share, sell, rent, or otherwise disclose your mobile number, SMS opt-in data, or SMS consent information to any third parties or affiliates for marketing or promotional purposes. We may share your mobile number only with service providers strictly necessary to deliver the SMS service to you (for example, our telecommunications platform DialPad and the underlying carriers used to transmit messages), and only for the purpose of delivering those messages. SMS content may also be disclosed where required by law or to protect rights, property, or safety as described in Section 6.

Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages.

Compliance. We operate our SMS program in a manner intended to comply with the Telephone Consumer Protection Act (TCPA), CTIA Short Code and Messaging Principles and Best Practices, and the requirements of The Campaign Registry (TCR) and US mobile carriers.


6. How We Share Information

We do not sell your personal information. We share personal information only as described below:

  • Service providers. Trusted vendors who perform services on our behalf — including hosting, email delivery, SMS/voice (DialPad), CRM (HubSpot), analytics, productivity, scheduling, document management, e-signature, accounting, and professional services. These providers are contractually limited to using personal information only to provide services to us.
  • Affiliates and portfolio companies. Where doing so is necessary to deliver requested services, evaluate a transaction, or operate a shared engagement, and consistent with this Policy.
  • Professional advisors. Our outside counsel, auditors, accountants, insurers, and similar advisors, under obligations of confidentiality.
  • Business transactions. In connection with a financing, merger, acquisition, reorganization, sale of assets, due diligence process, or insolvency, where personal information may be transferred or disclosed as part of the transaction.
  • Legal and safety. Where we believe in good faith that disclosure is required to comply with applicable law, legal process, or governmental request; to enforce our agreements; or to protect the rights, property, or safety of Achiever Capital, our personnel, clients, portfolio companies, or others.
  • With your direction or consent. Any other party you direct us to share with, or where you have provided consent.

As stated in Section 5, SMS opt-in data and consent information are never shared with third parties or affiliates for marketing or promotional purposes.


7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide services to you, maintain business records, satisfy legal, tax, accounting, and regulatory requirements, resolve disputes, and enforce our agreements. When personal information is no longer needed, we delete, anonymize, or securely archive it in accordance with our internal retention schedules.

SMS message content and metadata are retained for the period reasonably necessary to provide the service and comply with applicable record-keeping obligations.


8. Cookies and Tracking Technologies

The Site uses cookies, pixels, web beacons, and similar technologies to operate the Site, remember your preferences, measure traffic and engagement, and improve our content. Some cookies are strictly necessary for the Site to function; others support analytics and performance measurement.

You can manage cookie preferences through your browser settings. Disabling cookies may affect Site functionality. Where required by law, we will request your consent before placing non-essential cookies.

We do not currently respond to "Do Not Track" browser signals, but we do honor the Global Privacy Control (GPC) signal as an opt-out of sale or sharing for residents of states where the law requires us to do so.


9. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. These include access controls, encryption in transit, vendor due diligence, and ongoing monitoring. No method of transmission over the internet or method of electronic storage is fully secure, however, and we cannot guarantee absolute security.

10. Your Rights and Choices

Depending on where you live and the law that applies, you may have certain rights regarding your personal information, including:

  • the right to know or access the personal information we hold about you;
  • the right to request correction of inaccurate or incomplete personal information;
  • the right to request deletion of personal information, subject to legal exceptions;
  • the right to opt out of certain uses of your information, including marketing communications and SMS (see Section 5);
  • the right to portability of personal information you have provided; and
  • the right to non-discrimination for exercising your privacy rights.

To exercise any of these rights, email privacy@achievercapital.com with a clear description of your request and the email address or phone number associated with your information. We will respond within the time period required by applicable law. We may need to verify your identity before fulfilling certain requests.

You may also designate an authorized agent to submit a request on your behalf, subject to verification.


11. Notice for California Residents (CCPA/CPRA)

This section provides additional information for California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA").

Categories of personal information collected. In the 12 months preceding the Effective Date, we have collected the following categories of personal information, as defined by the CCPA: identifiers (name, email, phone, IP address); commercial information (services requested, transaction history); internet or other electronic network activity (browsing, interaction with the Site); geolocation data (approximate, derived from IP); professional or employment-related information (employer, title); and inferences drawn from the above to create a profile reflecting preferences and characteristics.

Sources, purposes, and disclosures. See Sections 2, 3, and 6 for sources of collection, purposes of use, and categories of recipients.

Sensitive personal information. We do not collect sensitive personal information for purposes of inferring characteristics about you.

Sale or sharing of personal information. Achiever Capital does not sell personal information, and does not "share" personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have not done so in the preceding 12 months. We do not sell or share the personal information of minors.

California rights. California residents have the right to: (a) know what personal information we collect and how we use and disclose it; (b) access a portable copy of personal information we hold about them; (c) request deletion of personal information; (d) request correction of inaccurate personal information; (e) opt out of any sale or sharing (which we do not engage in); (f) limit the use and disclosure of sensitive personal information (which we do not use beyond permitted purposes); and (g) not be discriminated against for exercising these rights.

How to submit a request. Email privacy@achievercapital.com or call (617) 420-8010. We will verify your request by matching the information you provide against records we maintain. Authorized agents may submit requests with written authorization and proof of identity.

Appeals. If we deny your CCPA request, you may appeal by replying to our response with the word "Appeal" in the subject line.


12. International Visitors

Achiever Capital is headquartered in the United States, and the Site is hosted in the United States. If you access the Site from outside the United States, your information will be transferred to, stored in, and processed in the United States, which may have data protection rules that differ from those in your country.


13. Third-Party Links

The Site may contain links to third-party websites, services, or content (for example, LinkedIn, podcast hosts, or partner sites). This Policy does not apply to those third parties, and we are not responsible for their privacy practices. Review their policies before providing information.


14. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be communicated through the Site and, where appropriate, by email. Your continued use of the Site or our services after the changes take effect constitutes acceptance of the revised Policy.
